Right of Withdrawal

This page is the statutory withdrawal instruction and the model withdrawal form. It applies to every consumer who buys from us, wherever you live: this contract is governed by German law, and § 13 BGB defines a consumer as any natural person entering into a contract for purposes outside their trade, business or profession. You do not have to be in Europe to have this right.

One section of this page matters more than the rest, and it is the one headed When the right of withdrawal ends early. Please read that one even if you read nothing else.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract was concluded.

To exercise the right of withdrawal, you must inform us —

— of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but this is not obligatory. A plain email saying you wish to withdraw is entirely sufficient.

To meet the withdrawal deadline, it is enough that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed of your decision. We will use the same means of payment you used for the initial transaction, and you will incur no fees as a result of the reimbursement.

When the right of withdrawal ends early

This section matters, and we would rather be blunt about it than bury it.

Digital content delivered immediately. For contracts for the supply of digital content not supplied on a physical medium, the right of withdrawal expires before the fourteen days are up if we have begun performance of the contract and you have

• expressly consented to us beginning performance before the end of the withdrawal period, and
• acknowledged that by giving that consent you lose your right of withdrawal once performance has begun.

Both statements are presented to you at checkout as two separate confirmations you have to tick, in plain words, immediately above the payment button. Neither is pre-ticked and neither is bundled with anything else. Both are checked again on our server, so an order missing either one is refused and no payment is attempted. If you do not give that consent, we cannot generate the report at all, because generating it is what would end the right.

In practice this applies to every report generated the moment payment clears — the full birth chart report and the synastry report among them — because those are delivered within seconds of the confirmation. Once your report has been generated, the statutory right of withdrawal in respect of it is gone. Our voluntary guarantee below is what remains, and it is not nothing.

Readings written by hand. A reading a person writes for you is a service rather than instantly supplied digital content. The right of withdrawal for it ends when the service has been fully performed, and only where you expressly asked us to begin work before the end of the withdrawal period and acknowledged that you lose the right once the work is complete. That is the second tick box on that checkout. Before we start work, you may withdraw freely and we refund in full. Where you withdraw after we have started but before we have finished, you pay a proportionate amount for the work done up to that point, and we refund the rest.

Subscriptions. A subscription is an ongoing service. You may withdraw from it within fourteen days of concluding it. Where you asked for access to begin immediately — which is what subscribing does — and acknowledged that, you pay a proportionate amount for the period you actually had access, calculated by reference to the total price of the billing period, and we refund the balance. Where a premium report was generated for you during that period at your request, with the two confirmations above, the withdrawal right in respect of that report has expired and its value is not refunded. After the fourteen days, ending a subscription is done by cancelling it rather than by withdrawing from it; cancelling is free, immediate and available in your account settings at any time, and is described in section 9 of the terms.

Our voluntary guarantee

The paragraphs above describe your rights under the law. We go further than them voluntarily, and the extra promise applies even where the statutory right has expired: if a report does not contain what its product page said it would contain, if it never arrived, or if it arrived late without our telling you first, we refund it in full. Nothing in that voluntary promise limits your statutory rights, and where the two differ, whichever is more favourable to you applies.
